Based on what you tell me, I will determine whether there is an at-fault party who is responsible for your damages.
Once you retain me as your lawyer, I will:
- Contact the insurance company of the at-fault driver and let them know that you have retained a lawyer. From that point on, the burden of dealing with the insurance company will be taken off your shoulders and placed on mine.
- Deal with property damage to your car. I will help you obtain estimates from body shops, make sure they do a competent job of repair work, get a rental vehicle and negotiate the resolution to your claim. Then I will determine if you have a diminution of value claim and resolve that issue as well.
- Help you obtain appropriate medical care. Once you have completed treatment and achieved maximum medical improvement, I will obtain all of your medical records, review them, put together a settlement package for the carrier and begin the process of negotiating a resolution. If we can't get a reasonable settlement offer, I will proceed to file a lawsuit against the party who injured you.
If the other driver is uninsured or does not have enough insurance to pay for your damages, I will help you file a claim against your own coverage for uninsured and underinsured motorists.
If the other driver was drunk, I will aggressively pursue punitive damages to punish the outrageous behavior of driving while intoxicated.
My attorney's fee is contingent on my success in obtaining a settlement or a jury verdict for you. If I am successful, I will receive a percentage of the money I recover for you. Any expenses, such as for accident reconstruction or expert witness fees, are in addition to the attorney's fees.
