Additional claims in construction accident cases
After any serious construction injury, the Occupational Safety and Heath Administration will investigate the accident to see if there was a violation of safety regulations. If your employer has a history of OSHA or other labor law violations, we may have a potential claim against your employer in addition to your workers' compensation claim.
If your injury was caused by someone other than your employer, we may have a personal injury claim against the responsible party. On construction sites, there are general contractors, subcontractors and property owners who may be responsible for unsafe conditions. If the person who injured you was an employee of another company, we can file a personal injury lawsuit against that company.
Examples of third party injury claims include:
- The collapse of scaffolding built by a subcontractor
- Being injured by an object dropped by a subcontractor
- Negligence of a property owner or another vendor (such as an uncovered hole)
- An injury caused by a crane or other piece of equipment
